Practice

Anthony Speaight is a commercial practitioner with extensive experience of technology and construction work, including related property litigation and professional negligence.

He also has specialist experience in public, regulatory and disciplinary work, especially in relation to the financial services industry.

Construction

He has practiced extensively in the Technology and Construction Court. He acted at first instance, Court of Appeal and House of Lords in Linden Gardens v Lenesta Sludge concerning assignment of rights of action to new property owners.

He appeared in 2005 in the Court of Appeal case Connex v M J Building concerning construction adjudication.

Recent engineering work has included acting in a TCC claim for $177 million relating to a 'BOT' project for a power station in Mexico. He also has considerable recent experience of railway engineering work.

He has been in many arbitrations and adjudications concerning building projects. He has been appointed as an arbitrator on several occasions. He is a TECBAR accredited adjudicator.

Technology

His technology work includes considerable experience of computer cases. He had the leading brief in the TCC action relating to the London Fire Brigade command and control system. He recently acted in a contractual and copyright dispute about a web site tried in the Chancery Division.

Professional negligence

In 2007 he acted for Lord Malmesbury in the £100 million claim against Strutt & Parker.

He appeared in Gable House Estates v Halpern, which is believed to be the largest architect's negligence claim ever tried. He has acted in many professional negligence claims involving engineers, architects and surveyors.

Insurance

He has appeared in important reported cases on the meaning of policies of professional indemnity insurance and property insurance.

Public Law

He has for many years been interested in the relevance of public law to construction work. He acted in judicial review proceedings concerning the construction of the channel Tunnel Rail Link, and concerning new gas installation regulations.

In 2007 he appeared in the Commercial Court and the Court of Appeal in Sumukan v Commonwealth Secretariat concerning allegations of irregularity in the proceedings of the Commonwealth Secretariat Arbitral Tribunal.

Property

He also has a long standing interest in property aspects of public law. He has been in numerous reported cases concerning enforcement of town and county planning. He appeared in the House of Lords in R v Wicks concerning the status in public law of enforcement notices.

Other property work has recently included securing leave to appeal from the House of Lords on the issue whether the law of adverse possession in registered land is incompatible with the European Convention of Human Rights.

Financial services and other disciplinary work

He acted for one of the largest British independent financial advisers in an action against the regulators. He appeared in R (Fleurose) v Securities and Futures Authority where the issue was whether the European Convention of Human Rights affected financial services disciplinary proceedings. He has advised one of the largest insurance companies on regulatory matters.

He has appeared in professional disciplinary tribunals on behalf of barristers, architects, and regulated members of the financial services industry. In 2005 he acted for the successful party in P (a barrister) v Bar Council concerning disqualification for bias, as a result of which the composition of all Bar Council disciplinary tribunals had to be changed.
