Building, engineering and energy

David specialises in litigation and arbitration concerning the construction industry which involves him in most, if not all, types of construction dispute. He has appeared in the House of Lords on issues concerning arbitration clauses in standard form contracts and on the "no loss" issue which has been the subject of much litigation in recent years, and regularly in the Court of Appeal on a wide range of issues including professional negligence, assignment, mistakes by adjudicators and contract formation. He has wide experience at first instance and in arbitrations.

Professional negligence

David deals with cases involving allegations of professional negligence against construction professionals including architects, engineers, quantity surveyors and project managers. He acts both for and against these professionals.

Arbitration

David has extensive experience in arbitration, both as arbitrator and counsel. As arbitrator he has been appointed by the ICC and on an ad hoc basis as sole arbitrator in disputes of a wide ranging nature. He acts for clients based in the UK and overseas.

Government work

David is regularly instructed by various departments of the UK government in both Francovitch claims and building engineering cases. He represented the Government in the Factortame litigation when the assessment of damages was transferred to the TCC. He is leading the Government team in commercial litigation concerning the implementation of EU insurance directives. He has also been instructed in disputes concerning road building, defence contracts and procurement.

Information technology

David also specialises in contentious and non-contentious information technology law and acts in disputes relating to computer hardware and software. He acts for software houses, blue-chip companies, UK government departments, IT consultants, education institutions and insurers. His experience includes representing some 37 Police Authorities suing in respect of fingerprint recognition software.
