Construction and engineering

Rachel has extensive experience in representing both employers and contractors in all types of dispute whether in the TCC, arbitration, adjudication or mediation.

Her practice encompasses claims ranging from significant residential disputes to large construction projects including highways, hospitals, leisure complexes, office blocks and shopping centres.

She is frequently instructed by government departments in respect of construction disputes including, in particular, claims involving the NEC standard forms of contract.

She has particular specialist experience in procurement matters including claims involving the breach of European Procurement Regulations and in advising in relation to performance bonds.

She was part of the team instructed in Alfred McAlpine Construction Ltd v Unex Investment Properties Ltd following the "no loss" House of Lords decision.

Professional negligence

Rachel's professional negligence work includes claims against construction professionals, accountants and solicitors.

She has particular experience in adjudication and mediations involving claims against construction professionals.

She also has experience of appearing before other tribunals such as the Architects Registration Board.

Insurance

Rachel's insurance work includes advising insurers on non-contentious matters as well as advising and acting in contentious matters, particularly fraudulent claims. She is regularly instructed to act on behalf of insurers in subrogated claims and, in particular, fire claims.

Energy

Rachel has been instructed in a significant number of Energy cases including acting for an international energy provider in a multi-million pound dispute arising out of the construction of a CHP Power Station; acting for a large contractor in respect of claims arising out of Turnkey Contract for an Integrated Materials Recovery and Energy Centre (contract price £23 million); and instructed by one of the largest UK energy suppliers in relation to its £18m claim arising out of a failure at a Combined Cycle Gas Turbine Power Station.

Information technology

Rachel is a member of the 4 Pump Court IT Group.

She is regularly instructed on behalf of government departments in relation to information technology disputes arising out of the multi-million pound contracts awarded by Government. Rachel has been involved in cases concerning both hardware and software and is familiar with the technical issues of IT disputes. She has experience of advising on contract termination issues and injunctive relief.
