Alex Potts KC has appeared before the Grand Court of the Cayman Islands
Alex Potts KC has appeared as Leading Counsel before the Grand Court of the Cayman Islands in three different judgments published by the Court in March 2024 and April 2024.
In the case of Raiffeisen Bank International AG v Scully Royalty Ltd et al, Grand Court of the Cayman Islands, FSD 0162 of 2019 (RPJ), 19 March 2024, Mr. Justice Parker dismissed an application by the prospective 9th Defendant that the Judge should recuse himself from hearing further applications in the multi-party litigation, on grounds of apparent bias and predetermination arising from the Judge’s decisions involving previous applications made by other Defendants in the litigation.
In the case of Kingkey Financial International (Holdings) Ltd, Grand Court of the Cayman Islands, FSD 0056 of 2024 (JAJ), 12 April 2024, Mr. Justice Asif granted an urgent application for the appointment of Provisional Liquidators over a company, for debt restructuring and supervisory purposes.
In the case of Carrefour Nederland BV v Suning International Group Co Limited et al, Grand Court of the Cayman Islands, FSD 0304 of 2023 (IKJ), 15 April 2024, Mr. Justice Kawaley dismissed an application to set aside, stay, or suspend the recognition and enforcement of a HKIAC Arbitration Award in the Cayman Islands.
