Anna Hoffmann secures intervener status for nearly 200 LGBTQIA+ organisations in upcoming landmark Privy Council case

Anna Hoffmann, together with Adam Goldenberg and Grace McDonell (both at McCarthy Tétrault), is acting pro bono for LGBTQIA+ advocacy organisations that have been granted intervener status by the Judicial Committee of the Privy Council in the upcoming case of Jason Jones v The Attorney General of Trinidad and Tobago. This appeal is the first occasion the Privy Council is asked to determine the compatibility of provisions criminalising consensual same-sex intimacy with the constitutional rights and freedoms guaranteed by a Caribbean constitution. It will be a landmark case for the LGBTQIA+ movement and raises very interesting questions of constitutional construction. 

The Interveners are Colours Caribbean, The Silver Lining Foundation, OUTBermuda, United Belize Advocacy Movement, and ILGA-North American and the Caribbean (ILGA-NAC). They are all leading LGBTQIA+ advocacy groups working in the Caribbean and North America, working in the field of LGBTQIA+ rights protection, and represent nearly 200 regional and local organisations. The intervention will allow the Privy Council to hear independent submissions informed by regional experience, community insight and the rights and freedoms at stake in the appeal.
