Judgment handed down in McGrath Tonner (A Law Firm) v McLean, CICA Civil Appeal No 13 of 2022
The Cayman Islands Court of Appeal delivered judgment last week in a case of considerable interest to the offshore legal profession, being McGrath Tonner (A Law Firm) v McLean, CICA Civil Appeal No 13 of 2022. Alex Potts KC appeared for the Respondent, instructed by Conyers. The appeal presented the first occasion on which the Cayman Islands Court of Appeal was invited to determine the scope of the Grand Court’s inherent jurisdiction, or common law power, to direct a taxation of the fees charged by Cayman Islands lawyers, as officers of the Court, to their own clients. In light of certain concessions made by the Appellant, however, the issue of principle was reserved for consideration and determination on a future occasion.
