Judgment handed down in Phlo Technologies Ltd v Tallaght Financial Ltd (t/a Cubefunder) [2025] EWHC 1405 (Ch)

Simon Goldstone and Jonathan Schaffer-Goddard, instructed by Addleshaw Goddard, acted for Phlo Technologies Ltd, the successful party in an insolvency decision regarding the appointment of administrators under Paragraph 14 of Schedule B1 to the Insolvency Act 1986.

The case arose out of allegations of fraud by a former director of the Applicant, and of collusion with the Respondent lender.

This case involved the High Court issuing an injunction restraining the threatened out-of-court appointment of administrators under this provision of the Insolvency Act. Nicola Rushden KC, sitting as Deputy High Court Judge at the return date, granted the application to continue the injunction.
