Judgment handed down in Westgreen Construction Ltd v Kiryukhina [2026] EWHC 2189 (TCC)

Mrs Justice O’Farrell DBE granted summary judgment enforcing the adjudicator’s decision for £650,000, together with VAT, the adjudicator’s fees and interest.

The Court rejected the jurisdiction and natural justice challenges, refused a stay of enforcement and awarded Westgreen its costs on the indemnity basis.

The judgment is a useful reaffirmation of the robust approach taken by the TCC to adjudication enforcement and the limited circumstances in which jurisdictional or natural justice challenges will prevent enforcement.
