M Davenport Builders Limited v Greer – For how long can the cracks be papered over?

The latest edition of our Construction Newsletter features the recent decision given by the Technology & Construction Court in M Davenport Builders Limited v Greer [2019] EWHC 318.

This is the first TCC case to apply S&T(UK) Ltd v Grove Developments [2018] EWCA Civ 2448. The newsletter, written by George Woods, explains the difficulties arising from that decision remain unresolved and there may be uncertainty for parties as to whether on the particular case before them, judges at first instance will restrain a true value adjudication after an unpaid smash and grab adjudication.
