In this edition, James Leabeater KC and Jennie Gillies discuss a new decision from Mauritius which set aside an arbitration award where the contract was alleged to have been agreed in breach of procurement laws. They wonder whether the decision is consistent with the general concept of separability of arbitration clauses, and compare it with a similar case decided last year in the Commercial Court.
