Adam Temple appeared for the interested party, AIB, in Mazarona Properties v Financial Ombudsman Service (currently unreported), successfully supporting the FOS’s position that it had no jurisdiction to consider complaints about the conduct of the FCA Review into Interest Rate Hedging Products. Mitting J rejected the Claimants’ application for judicial review, following a close analysis of section 226 of the Financial Services and Markets Act 2000 and the DISP section of the FCA Handbook.
