Permission to appeal granted in Sucden Financial Limited v (1) TMT Metals AG, (2) Prateek Gupta, (3) Mine Craft Limited [2025] EWHC 2006 (Comm)

The Court of Appeal has granted permission to appeal the decision of Mr Justice Knowles in Sucden Financial Limited v (1) TMT Metals AG, (2) Prateek Gupta, (3) Mine Craft Limited [2025] EWHC 2006 (Comm).

Described as a “key precedent on international fraud jurisdiction” by the Solicitors Journal, the Court of Appeal has now granted Mr Gupta permission to appeal Mr Justice Knowles’ finding that the courts of England and Wales have jurisdiction in the matter. The Court of Appeal hearing is listed for July 2026.
