Michael Davie KC acted for the successful appellant and its property insurer in R&S Pilling t/as Phoenix Engineering v UK Insurance [2017] EWCA Civ 259. The Court of Appeal held that the policyholder’s liability for fire damage arising from the insured’s off-road repair of his vehicle was covered by the wording of his motor insurance policy and was also covered by the compulsory insurance provisions of the Road Traffic Act for liability for loss caused by or arising out of vehicle use.
