James has significant experience in international arbitrations, both as sole counsel and as part of a larger team. He has acted under all the main institutional rules as well as in disputes governed by foreign law. He has particular expertise in large scale high value infrastructure disputes and onshore and offshore energy work where very complex technical issues arise that call for detailed expert cross-examination. He also has significant experience in relation to associated interim relief, including in relation to bonds and other securities.

James represents clients worldwide in all aspects of projects and construction and engineering disputes. He regularly acts in large scale, complex multi-party cases, either alone or heading up a team with the assistance of a junior. He enjoys highly technical cases, especially those involving large teams of experts and is an experienced cross-examiner. He has significant experience of insolvency-related construction disputes as well as those where serious allegations of fraud and dishonesty are being made.

  • Dispute regarding economic duress as a vitiating factor in relation to inter-related plant supply contracts for a major high-profile redevelopment (TCC, London).

  • Disputed termination of a hotel renovation on the French Riveria involving multiple allegations of dishonesty (TCC, London).

  • Concurrent arbitrations concerning a World Bank funded road redevelopment scheme in Ethiopia, acting alone against silk (ICC arbitration)

  • Arbitration concerning a major Middle East infrastructure project, involving disputes over the duty of good faith, programming and quantum evidence, acceleration and delay issues (ICC arbitration).

  • Acting in several large multi-party proceedings for consulting engineers regarding alleged defects in fire strategy and cladding systems, including consideration of the Defective Premises Act 1972 and Building Liability Orders under the Building Safety Act 2022 (TCC, London)

James has particular experience in disputes in Africa, the Middle East and the Far East. He has significant experience in disputes where the applicable law is not English law, including disputes involving Sharia law.

James has significant experience in relation ot renewables disputes, including cases involving Mechanical-Biological Treatment (MBT) plants, processing of Refuse Derived Fuel (RDF); Energy-From-Waste (ERF), biomass power generation / anaerobic digestion, as well as wind, solar and nuclear power generation, as well as hydrocarbons.

  • Advising an allegedly negligent director of a property developer on his personal liability for professional negligence and in relation to disputed policy coverage with his insurer.

  • Advising and representing private clients in their claim against their professional team arising out of the abortive re-development of a large property in central London which included an “iceberg” basement.

  • Advising and representing a monastery in relation to allegations of professional negligence surrounding a complex and challenging design of new church furniture.

  • Advising and representing a trust regarding a major property development in an alleged negligently-conducted tender selection process which also involved over-certification disputes.

  • Advising and representing insured contractors following insurers’ repudiation of liability following complex, multi-year, multi-insurer dispute under public liability policies.

  • Advising and representing clients in respect of complex claims for insured and uninsured losses following the sudden closure of offices in the City of London for emergency structural repairs.

  • Advising and representing insurers in relation to professional negligence and public liability insurance issues arising out of the total loss of a pier.

  • Obtaining urgent mandatory interim injunction for delivery up of insurer’s case files by their delegated authority agent. The case gave rise to detailed consideration of the English Court’s jurisdiction under s44 of the Arbitration Act 1996.

  • Represented an offshore insurance undertaking in relation to a complex series of claims against its broker and its broker’s directors, involving urgent applications under s44 of the Arbitration Act 1996, an arbitration and subsequent litigation, and follow up tracing of monies allegedly misappropriated by the directors in breach of trust.
