Aidan Christie KC represented the successful defendant in this recent interesting case, which may be one of the last claims to be dealt with under the pre 2015 Act law. Mr Justice Baker held that insurers were entitled to avoid the policy for material misrepresentation and non-disclosure. The Judgment also dealt with issues relating to the imputation of knowledge to an underwriter of claims notified only to the claims department, waiver of disclosure and inducement.
