Alex Potts KC has recently been representing SIR Real Estate LLC, now trading as Dubai Sotheby’s Real Estate, in the DIFC Court of First Instance, on the instructions of Al Tamimi and Company.
On 27 September 2023, Mr. Justice Robert French (former Chief Justice of the High Court of Australia) delivered an important judgment in favour of SIR Real Estate LLC, dismissing an application for an urgent interim injunction brought by a former marketing and branding agent who was seeking to prevent Dubai Sotheby’s Real Estate from engaging in a re-branding exercise.
The Court accepted the Defendant’s submissions that the Claimant’s claim did not disclose a serious issue to be tried.
The judgment of Mr. Justice French addresses some important issues under DIFC law regarding the availability of specific performance and injunctive relief in contractual cases involving the provision of professional services, as well as intellectual property, branding and trademark-related issues.
