Judgment was handed down last week in the matter of Financial Conduct Authority v (1) Wealthtek LLP (2) Jonathan Edward Dance. This is the latest decision from the Chancery Division in these proceedings brought by the regulator arising from its investigation into WealthTek LLP and Mr John Dance in which James Purchas has been representing the FCA since April 2023.
This judgment concerned an application by the FCA for an interim stay of its civil proceedings against Mr Dance so that it could prioritise its criminal investigation into him in respect of the overlapping subject matter. HHJ Baumgartner (sitting as a Judge of the High Court) granted the FCA’s application for a 12-month stay which had been resisted by Mr Dance. James Purchas appeared with Martin Evans KC on behalf of the successful FCA.
